Get Cinco – Generative AI Policy & Legal Terms

This Generative AI Policy (“Policy”) explains how Get Cinco, LLC (“Get Cinco,” “we,” “us”) designs, offers, and governs features that use generative artificial intelligence (“AI Features”) within our products and services (the “Services”). By enabling or using AI Features, you (“Customer,” “you”) agree to these terms in addition to our Terms & Conditions, Privacy Policy, Acceptable Use Policy, and Data Processing Addendum (as applicable).
We believe AI is a feature, not a replacement for human judgment. Our approach emphasizes transparency, fairness, privacy, and safety, with humans kept firmly in the loop.
1) Scope & Applicability
This Policy applies to: (a) AI Features offered in the Services; (b) our employees and contractors when building or operating AI Features; and (c) Customers, partners, and authorized users who access AI Features through the Services. It does not change your underlying contract; where conflicts arise, the Terms & Conditions control.
2) Key Definitions
- Customer Content: data you or your end users submit to or through the Services (e.g., reviews, messages, listings data, posts, survey responses).
- AI Output: content produced by AI Features (e.g., suggested replies, summaries, sentiment insights, draft posts).
- Personal Data: information that identifies or can reasonably identify a person.
- Third-Party AI Provider: a cloud or model provider that helps us deliver AI Features.
3) Core Commitments
- Human Oversight. AI is assistive. You control whether to use, edit, or discard outputs; your team remains responsible for final decisions.
- Transparency. We clearly label AI-assisted features and explain high-level behavior and limitations.
- Fairness & Safety. We work to reduce harmful, biased, or unsafe outputs and operate guardrails to block disallowed content and uses.
- Privacy First. We handle Personal Data according to our Privacy Policy and do not allow Customer Content to be used to train third-party foundation models.
- Security. We apply administrative, technical, and organizational measures appropriate to the data and risk level.
4) Data Handling & Privacy
- Processing Purpose. We process Customer Content solely to provide, secure, troubleshoot, and improve AI Features you enable, consistent with our Privacy Policy.
- Model Training. We don’t use your Customer Content to train third-party foundation models. Where we rely on a Third-Party AI Provider, we contractually require “no training” on your data for generalized model improvements.
- Temporary Caching. To generate an AI Output, systems may temporarily cache prompts or snippets. We minimize retention and apply access controls.
- De-identification. When feasible, we de-identify data used for evaluation, quality, or safety testing.
- Cross-Border Transfers. Data may be processed in the U.S. or other locations where providers operate; we use appropriate safeguards as required by law.
5) Confidentiality
- Get Cinco Confidential Information includes non-public business information, product plans, security measures, and internal documentation.
- Customer Confidential Information includes all non-public data you provide, including Personal Data, customer lists, communications, and configuration details.
Both parties agree to protect Confidential Information and use it only for the permitted purposes.
6) Responsible Use & Prohibited Activities
You will use AI Features legally, ethically, and in line with platform rules (e.g., review sites, carriers, social networks). You may not use AI Features to:
- Generate unlawful, harassing, hateful, sexually explicit, or otherwise unsafe content;
- Create or disseminate misinformation, fraudulent claims, or malicious code;
- Engage in political campaigning/advocacy or provide regulated professional advice as if definitive (legal, medical, financial) without required disclaimers and review;
- Circumvent platform rules (e.g., review-gating) or applicable consent and messaging laws (e.g., TCPA/A2P 10DLC).
We may throttle, block, or suspend AI Features to protect users, systems, and the public.
7) Customer Responsibilities
- Accurate Inputs. Provide truthful, lawful prompts and configuration.
- Human Review. Review AI Output before publishing, especially where tone, compliance, or facts matter.
- Consents. Obtain, honor, and record consents for messaging and data use; configure opt-outs.
- Platform Compliance. Follow the terms of each connected platform (e.g., Google Business Profiles, social networks, SMS carriers).
- AUP & Law. Comply with our Acceptable Use Policy and all applicable laws and industry standards.
8) Accuracy, Bias & Limitations
AI can make mistakes, omit context, or reflect biases in training data. Outputs may be inaccurate, incomplete, or not up to date. Treat AI Output as a draft to be fact-checked. Do not rely on AI Output where human expertise is required or high-risk decisions are involved.
9) Intellectual Property & Licenses
- Customer Content. You retain ownership of Customer Content. You grant Get Cinco a license to process it to deliver the Services.
- AI Output. Subject to third-party rights and law, we grant you rights to use AI Output for your business. You are responsible for ensuring that your use of AI Output (and any material you combine it with) does not infringe third-party rights or violate platform rules.
- Feedback. If you provide feedback about AI Features, you grant us a royalty-free, worldwide, perpetual license to use it.
10) Safety Systems & Guardrails
We implement layered controls to reduce unsafe or non-compliant content, including prompt and output filters, rate limiting, anomaly detection, and blocking high-risk categories (e.g., SHAFT content, explicit violence, illegal activity). Users may see refusals or safer alternatives when guardrails trigger.
11) Service Levels, Changes & Beta Features
AI Features may evolve rapidly. We may add, modify, or remove AI Features; we’ll aim to provide reasonable notice of material changes. Some AI Features may be labeled Beta or Preview and could be subject to additional terms, limited support, or usage caps.
12) Warranties, Disclaimers & Liability
- As-Is for AI. To the fullest extent permitted by law, AI Features are provided “as is” and “as available,” with no warranty that outputs will be accurate, complete, or fit for a particular purpose.
- No Outcome Guarantee. We do not guarantee specific rankings, review counts, or revenues from AI Output.
- Limits. Liability relating to AI Features is limited under the caps and exclusions in the Terms & Conditions. You agree to defend and indemnify us from claims arising from your misuse of AI Output or violations of law, platform rules, or this Policy.
13) Regulatory & Industry Compliance
We design AI Features to support compliance with applicable laws (e.g., privacy, marketing, consumer protection). You are responsible for configuring features to meet obligations in your industry (e.g., healthcare, finance) and jurisdiction, and for making any disclosures required to your end users.
14) Security & Incident Response
We maintain reasonable safeguards—including access controls, encryption in transit, environment segregation, monitoring, and personnel training. If we become aware of a security incident involving AI Features that affects your data, we will notify you consistent with law and our incident procedures.
15) Data Retention & Deletion
AI prompts and outputs may be retained for limited periods for delivery, troubleshooting, safety, or auditing, then deleted or de-identified. You may export or delete Customer Content per your plan and our data-retention practices.
16) International Use
If you access AI Features from outside the U.S., you consent to processing and storage where we and our providers operate. We use appropriate transfer mechanisms where required.
17) Updates to This Policy
We may update this Policy to reflect changes in law, technology, or our practices. The “Last Updated” date shows when it took effect. We’ll provide reasonable notice of material changes (e.g., in-app or email). Continued use of AI Features after the effective date constitutes acceptance.
